Land Donation and Purchase
Landowners can donate land to ACT for conservation purposes, leaving a priceless legacy to future generations. Donating land can provide substantial income tax deductions and estate tax benefits, while avoiding capital gains taxes that would have resulted from selling the property.
ACT also prepares grant applications to purchase conservation lands. Such lands are ultimately owned by a government entity or ACT. In partnership with multiple agencies, ACT has prepared and submitted numerous applications to the State of Florida’s Florida Communities Trust program and the Conservation & Recreational Lands Program or “CARL” (now Florida Forever) for projects like Prairie Creek Preserve, Blues Creek Ravine, the Hogtown Creek Greenway, Watermelon Pond, and Newnans Lake.
A conservation easement is a legal agreement between a landowner and ACT or government agency that permanently limits the use of the land to protect its conservation values. It allows the landowner to own and use their land and to sell it or pass it on to heirs. If an easement meets specific criteria defined by the I.R.S., donating an easement can result in reduced income and estate taxes. ACT has protected more than 3,214 acres via conservation easement.
In a bargain sale, a landowner sells land to ACT or a government agency for less than market value. The benefits of doing so are that the landowner realizes immediate income, is entitled to a charitable income tax deduction for the difference between fair market value and the selling price, and avoids some capital gain taxes. This option is appealing to landowners who wish to see their land preserved, but need immediate income.
